The proper defense of a drunk driving case begins with the administrative license revocation hearing ("ALR"). The ALR is a civil hearing, completely separate from your DWI case. Requesting this hearing prevents the automatic suspension of your driver's license and often allows us to either: 1) prevent your license from being suspended altogether, or 2) cross-examine the police officers to obtain valuable information and commit them to their story long before you come to court on the DWI charge itself.

Preventing a license suspension saves you hundreds of dollars in insurance and fees for obtaining an occupational drivers license. Having the officers' sworn testimony early on helps us impeach their credibility should they later testify differently or attempt to add previously-unmentioned damaging information at your trial. Either way, you can only come out ahead by having the ALR.

One of the main issues in your DWI case is something we develop at the ALR hearing: Did the officers have a lawful reason to stop you in the first place? If not, the law requires that all evidence obtained from the stop be excluded from use at your DWI trial. This means that your video, your field sobriety tests and any admissions you made could not be used against you, leaving the State nothing with which to prosecute you. When this issue comes up, we file what is known as a "motion to suppress," and the judge in your DWI case will hold a pretrial hearing to determine if the police stopped you unlawfully. If the judge rules in your favor, our motion will be granted, and the State will usually dismiss your case.

Even if the facts of your case do not support a motion to suppress, there are still plenty of ways to defend you. Most often our focus shifts from whether the police stopped you unlawfully to whether you were "intoxicated," though in some unusual cases the dispute is whether you were "driving."

In the absence of a valid breath or blood test, "intoxication" is difficult to prove because it is based on the opinions of police officers who have never met you, who do not know how you normally think, who do not know how you normally speak, and who have no idea of your physical abilities or limitations. They base their opinions primarily on field sobriety tests, which science tells us are not accurate predictors of intoxication for all people. To have any relevance, the police must administer the tests in strict accordance with government guidelines. We look for inconsistencies between the police reports and the videotape, and we carefully analyze the administration of the field sobriety tests, as well as your performance, looking for ways to challenge officers' opinions that you were intoxicated.

If there is no blood or breath test, and if reasonable minds would agree that you "look good" on the video, there is an increased likelihood that the prosecution will offer a reduced charge or minimal punishment for fear that we might choose to proceed to trial and be found "not guilty."

Blood and breath tests must also be administered according to strict guidelines, and the law requires routine maintenance of breath testing equipment. The results of such tests may not be admissible against you if the testing or maintenance procedures are not properly followed. Documents obtained through the ALR hearing will tell us if there was a issue with the breath machine or the blood specimen that merits further investigation or consultation with a toxicologist or other expert witnesses.
